Legal Consequences in Colombia:

Under Colombian law, plagiarism can lead to severe penalties. According to the Penal Code (Law 599 of 2000), plagiarism is punishable by prison sentences of 16 to 72 months and fines. Universities also have strict policies, which may include expulsion or revocation of degrees. In our case it would be the SENA.


Workplace Context: Fraud and Embezzlement

Fraud: In the workplace, fraud refers to deception intended for personal or financial gain. This can include falsifying documents or misrepresenting information.

Embezzlement: Embezzlement is the theft or misappropriation of funds placed in one's trust or belonging to one's employer.

Legal Consequences in Colombia:

Both fraud and embezzlement are criminal offenses under Colombian law. Penalties include imprisonment and significant fines. For instance, the Penal Code stipulates that embezzlement of public funds can lead to imprisonment from 64 to 216 months and fines up to 1,500 times the minimum wage.

Preventive Measures

  1. Education and Training: Institutions should educate students and employees about ethical practices and the legal ramifications of crimes like plagiarism and fraud.
  2. Policies and Enforcement: Clear policies and strict enforcement mechanisms should be in place to deter such behaviors.
  3. Technological Tools: Utilizing plagiarism detection software and financial auditing tools can help prevent and identify misconduct.
